By commissioning an artwork or service from kobaraven, you agree and acknowledge the terms and conditions belowLast Updated: November 2024

1. General

1.1. Definitions- Custom Orders refers to Commissions made from scratch and Personalized (Your-Character-Here/YCH) refers to Commissions made with a Template.
- Surprise Me / Skeb Commissions refer to commissions with NO communication, Work-In-Progress (WIP) Updates, or Revisions. Revisions may be given for mistake fixes/re-exporting, but not guaranteed.
- A Phase refers to the status of the Commission such as “Not Started”, “Rough Started” and “Touch Up Started”. A list of Phases will be provided depending on the commission.
- Short Term Projects refer to smaller projects that may span from 2 weeks to a month such as an Illustration.
- Long Term Projects refer to projects lasting over a month such as Live2D Model.1.2. Commission Process- If you are a perfectionist or accustomed to nitpicking on details (such as providing a large list of changes, piece by piece, or pick on pixel-level imperfections) rather than offering overall feedback, please inform me ahead of time, as I may not be able to accommodate your order.
- I have the right to reject a commission if I am not comfortable with the commission.
- After the payment, I will regularly send progress shots of the commission for feedback under a Phase. The quicker the Commissioner responds, the quicker the commission process will be.

2. Intellectual Property and Uses

2.1. Copyright and Usage- All rights belong to me. Please credit me (@kobaraven) with proper linking if applicable.
- I have the right to upload the artwork on my social medias. Commissions pieces may serve as an example for future commissions.
- Commissions may be done on live on streaming platforms such as Twitch and YouTube with permission.
- By default, all commissions included Commercial: Streaming and Content Use. This does NOT include Commercial: Merchandise / Print. Please contact me first for further discussion.2.2. Prohibited Activities- The Commissioner is not allowed to re-sell my commissions without permission.
- Artworks are NOT to be used for, or along side A.I. Generation Images and Productions.

3. Payments

3.1. Payment Currency and Services- By making a purchase, you confirm you are the authorized cardholder for the account.
- Payments are to be done through PayPal, VGen or another payment service that is agreed upon.
- Commissions are listed as USD. But can be paid in AUD if agreed upon.
- The final value will be the value agreed during the agreement between me and the Commissioner.
- After I send you an invoice, please pay as soon as possible. I will cancel a commission if a week has passed without notice.3.2. Payment Plan- Short Term Projects (such as an illustration) must be paid upfront before I start working.
- Long Term Projects (such as Vtuber Model) require a deposit of 25%, with the option to paid in two installments (50%) or paid in full upfront (100%)3.3. Additional Charges- Expedited Service (Rush Fee): For a faster turnaround, an rush fee of 1.5x the original cost will apply and must be informed in advance.
- Non-Disclosure Agreement (NDA): If you wish to keep the commission confidential, an NDA will be required at 2x the original cost will be applied and must be informed in advance.
- If both a Rush Fee and NDA is required, it will be 4.5 the original cost.
- Live2D Source File (cmo3): By default, the Live2D Rig Commission DOES NOT include the cmo3 file. It may be provided under circumstantial situations for an additional 3x times the original cost, on top base commission price.

4. Refunds

4.1. Refund Policies- Refunds are not available for Short Term Projects. If the order is canceled for reasons not related to me, the deposit will be non-refundable.
- Refunds will not be issued for unauthorized purchases, including those made by minors. All buyers must have the legal capacity to make payments.
- Refund Requests must be summitted within a reasonable timeframe and are subject to approval based on the Phase of the commission. Refund decisions are at the discretion of the service provider.
- If the Client is dissatisfied with the process or outcome of the commission, a refund may be issued depending on the Phase of the commission.4.2. Illustration RefundsIf the work is at the:- Not Started Phase - The deposit is non-refundable and will be retained
- Sketch Phase - If the initial sketches are provided or planned, 70% of the total commission price, minus the deposit
- Line Art Phase - 50% of the total commission price
- Touch Up Phase - 20% of the total commission price4.3. Live2D RiggingIf the work is at the:- Not Started Phase - The deposit is non-refundable and will be retained
- Early WIP (Face Rigging) - 70% of the total commission price
- Mid WIP (Angle/Body XYZ) - 50% of the total commission price
- Late WIP (Toggles, Touchup) - 25% of the total commission price

5. Revisions

5.1. Revision Policies- The Commissioner will receive Work-In-Progress shots and up to 2 Major Revisions per phase. Refer to “Additional Revision Fees” for definitions.
- Revisions refer to valid rounds of feedback, where each round includes your input followed by modifications until you're satisfied. If the modifications do not meet your expectations, it will not be count against your revision limit. However, repeatedly requesting additional revisions will incur extra fees.
- For Illustrations, it is prohibited to request modifications once the artwork has been completed and confirmed.
- After receiving the Live2D Files, up to 2 free modifications are allowed. If modifications are required due to issues with the illustration, each adjustment will incur an additional fee.5.2. Revision Counting- Single Revisions: One modification request counts as one revision. If the changes does not meet your expectations, any additional modifications related to the original request will not count toward the revision limit.
- Separate Revisions: If multiple, unrelated modification requests are made after changes have been made, each new request will count as a separate revision.5.3. Additional Fees- If you require more revisions then initially agreed upon, additional fees may apply. To ensure a smooth process, please provide as much detail as possible about your requirements. Additional Revisions Fees will need to be paid in full before the final files are sent to you.
- Revisions prices vary depending on the type of project, but can be classified into 3 groups:
1. Minor Revisions: Small tweaks that can easily and quickly be fixed. Can be for free or a small flat fee.
2. Major Revisions: Multiple Minor Revisions, major changes or adjustments for a flat price depending on the part that needs revision.
3. Large Revisions: Restarting, Reworking or Redesigning may result up to 50% of the original cost.
